These terms are the agreement between you and PopCart when you use the PopCart app or website. By creating an account or placing an order, you agree to them. Our privacy notice explains what we do with your data.
Who we are
PopCart is a Philippine business based in the Philippines, being incorporated as PopCart Technology Inc. (SEC registration in progress); until then it is run by its founder.
What PopCart does
PopCart lets you order fresh goods, grilled food and groceries from partner shops and has them delivered by a PopCart rider. The shop prepares your order; we take the order, the payment and the delivery.
Your account
- You must be 18 or older and give us a real email address and, when asked, a working mobile number.
- Keep your email account secure: anyone who can read your sign-in codes can sign in as you.
- One person, one account. Don’t use PopCart for anything illegal, abusive or fraudulent. We can suspend accounts that do.
Orders and prices
- Prices are in Philippine pesos and include VAT where it applies. Delivery and service fees are shown before you pay.
- Fresh goods sold by weight (fish, meat, produce) are estimated when you order and charged on the actual weight, within the limit shown at checkout.
- Stock is first come, first served. If a shop runs out after you order, we tell you and you don’t pay for what didn’t arrive.
- Delivery times are estimates. Our riders are fast, not magic.
Payment
- Pay cash on delivery, or by card, GCash or Maya through PayMongo. Online payments are subject to PayMongo’s own terms.
- An order paid online starts once the payment is confirmed. If the payment fails or you cancel it, the order waits for payment for a short time, then is cancelled and nothing is charged.
Cancellations and refunds
- You can cancel in the app, free of charge, until the shop accepts your order.
- If something arrives missing, wrong or not fit to eat, tell us in the app or at support.popcart@gmail.com within [OWNER TO FILL: report window, for example 24 hours] with a photo. We’ll refund or replace it.
- Refunds go back to the way you paid, within [OWNER TO FILL: refund processing time].
- Nothing here takes away your rights under the Consumer Act of the Philippines (Republic Act No. 7394).
Delivery
- Give an accurate address and pin, and be reachable. If the rider can’t reach you, they wait [OWNER TO FILL: wait time] and then contact support.
- The rider may take a proof-of-delivery photo of the parcel at your door.
- Be kind to riders and shop staff. Abuse gets accounts closed.
Shops and riders
Partner shops and riders have their own agreements with PopCart. The shop is responsible for the quality and safety of what it prepares; PopCart is responsible for getting your order to you and sorting it out when something goes wrong.
Our responsibility
We run PopCart with reasonable care and skill. To the extent the law allows, we are not liable for indirect losses, or for delays caused by things outside our control such as storms, floods, outages or road closures. Our total liability for an order is limited to what you paid for it, except where the law says otherwise.
Closing your account
You can delete your account any time in the app (Me → Account → Delete account) or at popcartph.com/delete-account. We may close accounts that break these terms.
Changes
We may update these terms. If a change matters, we’ll tell you in the app or by email before it applies. If you keep using PopCart after that, the new terms apply.
Law and disputes
These terms are governed by the laws of the Philippines. Talk to us first; most things get fixed in one message. If we can’t sort it out, disputes go to the courts of [OWNER TO FILL: city for venue].
